Neighbor failed to call police despite screaming, court told
A neighbor did not report a fight between a 39-year-old Gambian and his 40-year-old Filipino wife to police because he thought they would make up soon, a neighbor told the High Court on the second day of the murder trial.
Touray Ousainou was charged with murdering his 40-year-old wife Adele Melano Cuyacot. He turned himself in to police on April 10, 2019 after he found his wife dead after he woke up from an argument.
A neighbor who lived next to the couple at that time of the incident testified in the High Court today that he was watching a movie at home in the early hours of April 9, 2019, when he heard the couple arguing and the wife crying, yelling and asking Ousainou to stop.
He left his home and knocked on their door, but no one answered. The noises stopped as well. He then returned home, but noises came from the flat again shortly after. However, the neighbor didn't witness the two arguing.
The neighbor told the court that the couple had fought before and they usually reconciled very soon. Therefore, even thought he heard the two arguing and screaming at that time, he thought it was unnecessary to make a report to the police.
A police officer who contacted Ousainou at the police station was summoned. He said that Ousainou was carrying three suitcases when he arrived at the Wong Tai Sin Police Station at around 9.30pm on April 10. Ousainou greeted the officer in English and told the officer that he had argued with his wife in the morning, who then died.
The officer then gave him a ticket and told Ousainou to wait for his turn to report the incident. The officer added that Ousainou had been cooperative while at the police station.
The court also summoned a medic, surnamed Wong, who was mobilized to the subdivided unit where Cuyacot was found dead. He said the air-conditioning was “freezing” and that there was a smell in the flat. He also found Cuyacot lying naked on the bed, covered by a bed sheet.
Wong recalled that she had stopped breathing and had no pulse, and there was a dark brown bruise on her face. As he remove the bed sheet, he found there were other bruise marks on her limbs, as well as livor mortis on her body.
