Married teacher jailed 26 months for sexually assaulting underage student
A 37-year-old married male teacher was on Friday sentenced to 26-month imprisonment for sexually assaulting an underage female student between 2013 and 2015.
The secondary school teacher identified as C.C.H. in District Court was earlier found guilty of indecent conduct towards a child under the age of 16 and indecent assault.
When passing the sentence on Friday, judge Ernest Lin Kam-hung slammed C.C.H. for taking advantage of his authority and status and sexually assaulted the student “X” who admired and trusted him.
Lin also criticized the defendant's behaviors were like “soft violence” as he offered X car rides, sent sexual messages to X and invited her to come over to his Tsuen Wan home when his wife was not around.
Lin continued that the defendant's sexual assault almost equaled sexual intercourse. He also said X was an underage girl back then and could not consent to have sex with the defendant, meaning the defendant's crime could almost be counted as raping.
The judge referred to X's traumatic report and said she suffered from bipolar disorder after the incident and lost faith and trust towards others. Although she continued her study in the US later, she soon returned to Hong Kong because of mental problems caused by this incident.
Lin said the defendant ruined the bright future of X and decided to put him behind bars for 26 months.
Earlier, the court heard that the defendant invited X to his home to do revision for the Mathematics examination on November 29, 2013, when X was only 14-year-old.
The two went to the bedroom and chatted on the bed, where the defendant suddenly started kissing X and touched her private part with her clothings on. The defendant reached his hands under her underwear and later entered X’s private part with his fingers. He instructed X to help him masturbate as well.
One day in March 2015, X aged 15 back then was again invited to the defendant's home. When X was sitting on the sofa, the defendant started kissing her face and brought her into his room, where he took off her clothes, touched her breasts and entered her private part.
X cried when she left the defendant's home and the defendant later sent messages to X, saying she “melted his sausage.” The defendant also asked multiple times when would X have a blowjob with him again.
X reported the case to police in January 2019.
