Man jailed for nine years and four months for forcing 15-year-old boy into sex

A 48-year-old repeat sex criminal -- who earlier promised he will only make a move on youngsters aged 18 in the future -- was jailed for nine years and four months on Thursday after he forced a 15-year-old boy into oral and anal sex in 2019.
Electrician Lee Kwok-wai earlier pleaded guilty to buggery with the boy identified as X in court, indecent conduct towards X, indecently assaulting X, and making and distributing child pornography articles at his home at Hing Wah (II) Estate in Chai Wan on September 9, 2019.

He had committed similar sex crimes involving underage children 10 years ago, for which he was sentenced to 12 years imprisonment. He was released in July 2018.

Passing sentence in the High Court on Thursday, Judge Esther Toh Lye-ping said the only factor for reducing Lee's jail term by one-third was that he pleaded guilty so that the young victim need not testify in court and recount the traumatic event.

However, Toh pointed out that Lee didn't use protection when committing the crime, and he randomly "preyed on" innocent boys, adding that Lee is likely to commit a similar offense again.

Although Lee once promised he would check the identity cards of the youngsters to make sure they are all aged 18 or above before making a move on them in the future, Toh said it is unlikely that Lee will keep his promise.

Toh also noted Lee is 33 years older than the boy, who refused to see a psychiatrist despite the physical and mental conditions he suffered after the anal sex. Toh then suggested the prosecution inform the Social Welfare Department to follow up on the case.

Toh praised the boy as a hero for bravely reporting the incident to the police so that Lee could be stopped from hurting other children.

Lee approached X at a laundry shop in the early hours on September 9, 2019. He told X he was a rich man and could become X's father and give him money. When X arrived at Lee's home, Lee took away X's phone, asked X to become his wife, and started forcefully kissing X.

Lee took X to the shower, after which he forced X to perform oral sex on him for 10 minutes and had anal sex with X for 20 minutes.

In the morning, X said he must leave and go to school. Lee then walked X to a bus stop and gave X HK$30 for travel. X called his mother on the bus and reported the incident to the police on the same day. Lee was arrested on September 10, 2019.
