Man acquitted of raping insurance agent with drugged beer

A 37-year-old man who was accused of raping a 29-year-old insurance saleswoman by offering her drugged beer walked free while raising his hand in an okay sign in victory.
Lam Kim-fung, 37, was found not guilty of raping 29-year-old female insurance agent X, at his home at Tonning Mansion, Cheung Sha Wan on August 29, 2018.

He appeared in front of High Court judge Albert Wong Sung-hau, and was acquitted by a jury of six women and one man on Tuesday by a 5-2 decision.

Testifying in court earlier, X said she met Lam on WeChat in 2017 and Lam approached her in July 2018 to buy his parents insurance products from her. They met for the first time at a restaurant on July 28, 2018 and they headed to Lam's home after the meal. The first meeting ended in good terms.

The two later had another meal on August 29, 2018 and went to Lam's home again. X told Lam she wanted to have beer while explaining the details of the insurance products. Lam then left for around 10 minutes and afterwards offered two cans of beer to X. She lost consciousness when she finished half a can.

When X woke up she found that she was having sex with Lam. She added that she failed to resist Lam because of the influence of the drug as well as her fear of irritating Lam, who continued the sex without using protection.

X saw a doctor the next day who found zolpidem, one of the components of sleeping pills, in her body. X then reported to police and Lam was arrested on August 31, 2018.

Defending himself in court, Lam said it was X who suggested heading to his home to have a drink that day. He pointed out although X's face was flushed at that time, she definitely didn't lose consciousness.

Lam continued that X took the initiative and touched his hands, which Lam considered to be a green light for sex.

During the trial, the defense played three sex tapes that Lam secretly filmed, with one of them showing X saying: “I want to know if my boyfriend will join our game?”

The videos also showed Lam, who was naked on the bed with X, asked her if she would stay overnight, to which X replied “It doesn’t matter to me.”

Lam explained he shot the sex videos secretly in order to protect himself, after she told him earlier that she had ways to make people buy insurance after having sex with her. He secretly filmed their sex to prove X was conscious the whole time.

Lam also told the court that X offered him a deal for a compensated date at HK$3,500.

Prosecution slammed him for making up a story, and challenged why Lam approached a woman who allegedly offered a compensated date if he truly wanted to buy insurance products.

After six-hour closed-door discussion, five jurors out of seven were convinced he did not rape X. Lam gave the court audience an “Okay” hand gesture as he heard the jury decision.
