Mainland woman jailed for 14 months for giving birth in HK through false immigration claims
A 26-year-old pregnant mainlander was sentenced to 14 months in jail for concealing her pregnancy from Immigration Department staff in an attempt to give birth in Hong Kong.
The defendant appeared at the Shatin Magistrates' Courts yesterday facing an accusation of making a false representation.
According to the court, the defendant previously arrived in Hong Kong as a visitor and she afterwards went to an Accident and Emergency Department for delivery without prior booking, which led the Immigration Department to launch an investigation against her.
During the investigation, the defendant argued she had no knowledge about her pregnancy when she arrived in Hong Kong, adding she has no memory of the situation when she crossed the border.
However, the ImmD further found out the defendant had received an antenatal check in the mainland before she came to Hong Kong and acquired the medical record.
The defendant finally admitted that her real purpose to visit Hong Kong was giving birth and she falsely claimed to ImmD staff that she was not pregnant during arrival clearance.
She was subsequently charged and pleaded guilty to a count of making false representation to the ImmD before she was sentenced to 14 months imprisonment.
