The Department of Justice has appealed a District Court's decision in a case that saw Democratic Party chairman Lo Kin-hei acquitted of taking part in an unlawful assembly during the 2019 social unrest.
The DoJ on Monday filed the appeal by case stated to the appeal court, which saw Lo again arrested on Wednesday and brought to court the same day.
Lo was granted a HK$5,000 cash bail, on the condition that he does not leave the city and has to surrender travel documents. He is also required to report to the police once every week.
Commenting on the case, the Democratic Party said they will provide all necessary support to Lo and his family.
The District Court previously ruled that the politician had not taken part in clashes between protesters and the police, and that he did not interact with the protesters after the prosecution accused him of participating in a protest near the Science Museum on November 18, 2019.
The judge said the prosecution had not been able to prove beyond reasonable doubt that Lo participated in the unlawful assembly.
Three other people charged in the same case were convicted of unlawful assembly, while a fifth defendant was found guilty of possessing an offensive weapon.
